Terms and Conditions

1. About these terms

These terms govern access to Permitech, a hosted permit-to-work software service operated by Tenac Solutions Pty Ltd ("Tenac Solutions", "we", "us" or "our"), including its public website, applications and related services (the "Service").

By accessing the Service, you agree to these terms. If an organisation gives you access, you also confirm that you are authorised to use the Service for that organisation and will follow its policies and instructions. A separate written agreement between us and your organisation may also apply.

2. The Service

Permitech helps organisations create, review and manage permit-to-work records, supporting documents, work controls, approvals, audit history and related operational information. The Service may also connect to identity, mapping, utility, document and artificial intelligence providers.

Permitech is a software service. This website does not offer physical goods for delivery. Service scope, support, charges, subscription changes and cancellation arrangements are governed by the applicable written agreement or order between us and the relevant organisation.

3. Safety-critical use and AI-assisted outputs

Permitech supports, but does not replace, workplace processes, competent-person judgement or supervision. You and your organisation remain responsible for checking site conditions, utility information, permits, controls, evidence, approvals and work readiness before work starts or continues.

AI-assisted outputs, extracted information, provider results, suggestions and links may be incomplete, incorrect or out of date. They are not a permit approval, engineering advice, legal advice, a statutory clearance or an instruction to proceed. They must be reviewed against authoritative evidence by a competent person. Nothing in Permitech replaces any statutory, contractual, workplace health and safety or other safety duty.

4. Accounts and organisation administration

You must provide accurate account information, protect your sign-in credentials and promptly report suspected unauthorised access. You must not share an account or use another person's identity.

Organisation administrators control membership, roles, access scopes and configured features for their organisation. They may invite, suspend or remove users and may access or manage records held for that organisation, subject to the Service and the organisation's own policies. Contact your organisation administrator about access decisions made by your organisation.

5. Customer Data

"Customer Data" means information submitted to or generated through the Service for an organisation, including permit records, site and project information, documents, photographs, signatures, comments and provider or AI-assisted results. As between your organisation and Tenac Solutions, your organisation retains its rights in Customer Data. We retain our rights in the Service, software, designs and documentation.

You must only submit Customer Data that you are authorised to use and disclose. You and your organisation are responsible for its accuracy, quality, legality and the instructions given to us about it. We process Customer Data to provide, secure, support and administer the Service and as described in our Privacy Policy and any applicable written agreement.

6. Acceptable use

You must not:

  • access another person's account, organisation or data without authority;
  • bypass access controls, safety gates, audit records, usage limits or security measures;
  • upload malicious code or use the Service to interfere with systems, networks, providers or other users;
  • use the Service unlawfully, fraudulently or in a way that creates an unacceptable safety or security risk; or
  • copy, reverse engineer or commercially exploit the Service except to the extent permitted by law or a written agreement with us.

7. External services

Some features depend on third-party services. Provider data and links remain subject to provider availability, authority and source limitations. Where you or your organisation enable an integration, relevant information may be sent to or received from that provider to deliver the requested feature.

We do not control third-party websites or services and do not endorse content merely by linking to it. You must check provider information against the authoritative source before relying on it for safety-critical work.

8. Availability and changes

We may maintain, update or change the Service to improve security, reliability, legal compliance or functionality. The Service and external providers may occasionally be unavailable. Any service level or support commitment applies only if it is set out in a separate written agreement.

Your organisation should maintain appropriate operational contingencies and must not treat availability of the Service as the sole control for preventing unsafe work.

9. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect the Service, users, Customer Data or third parties, to respond to unlawful use, or to comply with an applicable agreement or legal requirement. Organisation administrators may also remove access within their organisation.

Customer Data access and handling after suspension, cancellation or termination are governed by the applicable written agreement, organisation settings, our Privacy Policy and applicable law.

10. Consumer rights and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. Any charges, credits, refunds or remedies are handled under the applicable written agreement and applicable law.

To the extent permitted by law, the Service is provided without a guarantee that it will be uninterrupted or error-free, or that provider or AI-assisted information will be complete, accurate or current. Any limitation or allocation of liability between us and an organisation is governed by its applicable written agreement.

11. Privacy and security

Our collection, use and disclosure of personal information are described in our Privacy Policy. You must promptly notify us or your organisation administrator if you become aware of a suspected account or data-security incident affecting the Service.

12. Changes to these terms

We may update these terms from time to time. We will publish the updated version and change the date shown above. Where appropriate, we or your organisation may also notify account users of a material change. Continued use after an updated version takes effect constitutes acceptance to the extent permitted by law.

13. Governing law and contact

These terms are governed by the laws of Western Australia and applicable Commonwealth laws. Courts with jurisdiction in Western Australia may hear disputes concerning these terms, subject to any rights that cannot lawfully be excluded.
